MN Short Sale Home Buyers Tend To Be Highly Satisfied Homeowners

Seventy-two percent of homeowners say they are satisfied with homeownership, according to a recent survey of more than 1,400 homeowners conducted by HomeGain, a provider of online marketing programs that connect agents and brokers with home buyers and sellers.

Among the 28 percent who said they were dissatisfied, 63 percent cited price depreciation as the main reason for their dissatisfaction.

Other dissatisfied homeowners cited the costs of owning and maintaining a home as major reasons for their dissatisfaction.

HomeGain also assessed satisfaction levels by sales type and found that homeowners who purchased a home through a short sale were the most likely to be pleased with their choice.

Eighty-three percent of short sale purchasers were satisfied homeowners.

Homeowners who purchased foreclosed homes were the group next likely to be satisfied with owning a home. The group reported a 79 percent satisfaction rate.

Existing-home and new home purchasers were least likely to be satisfied, though a majority of these homeowners

were still satisfied. Seventy-one percent of existing home purchasers and 73 percent of new home purchasers said they were satisfied.

Homeownership satisfaction varied somewhat by region with the highest satisfaction rates in the Northeast – 77 percent – and the lowest in the Midwest – 68 percent.

The Southeast and West fell in between at 73 percent and 71 percent, respectively.

When comparing satisfaction among homeowners of different age groups, HomeGain found that satisfaction was greatest among older homeowners and least prevalent among the youngest homeowners.

Homeowners ages 18 to 25 were the only homeowner to report more than a 50 percent dissatisfaction rate.

Fifty-five percent of homeowners ages 18 to 25 were dissatisfied with homeownership, while 24 percent of those 55 and older expressed dissatisfaction with being a homeowner.

The survey also found that home value was inversely related to homeownership satisfaction. Those whose homes are valued at less than $75,000 are 77 percent likely to be satisfied homeowners.

The rate trends steadily down as prices rise, with the highest category in the survey – homes valued at more than $801,000 – bringing in the lowest satisfaction rate – 69 percent.

Sixty-seven percent of dissatisfied homeowners with homes valued more than $801,000 cited price depreciation as a primary source of their discontent.

For those with homes valued less than $75,000, price appreciation was not a major factor in their outlook. Fewer than 40 percent of these homeowners cited price appreciation or depreciation as the primary reason for their position on homeownership.

MN Short Sales And Foreclosures

Many financially troubled homeowners are aware that foreclosure is a lengthy process. Some have heard stories about people living in their home for years without making a payment because their lender was overburdened with defaulted loans and foreclosures. Those stories may convince them that their best choice is to remain in their home without paying until forced to leave. That urge to remain in the home they know, coupled with the commonly-accepted notion that short sales are simply too difficult to complete, keeps many people who would otherwise be qualified from listing their home for short sale. Why go through the hassle when I could live rent-free for an indefinite period of time? How does a short sale benefit me, the struggling homeowner? Aren’t you just trying to earn a commission at my expense? However, now is the time to address these questions, and here is the answer: TAXES!

As a general rule, cancelled debt is treated by the IRS as income. A mortgage lender issues an IRS Form 1099-C anytime it cancels a portion of a homeowner’s debt – whether through short sale or foreclosure (foreclosure by advertisement or “non-judicial foreclosure” in Minnesota results in the lender forfeiting the right to pursue the deficiency, so the deficiency is cancelled debt). Under the Mortgage Forgiveness Debt Relief Act of 2007, in many circumstances the homeowner is not required to pay income tax on the cancelled debt However, the Act currently applies only to debt forgiven by the end of the 2012 calendar year. HOMEOWNERS CONSIDERING SHORT SALE MUST ACT NOW TO ENSURE THAT THE DEBT FORGIVEN ON THEIR HOME MORTGAGE DOES NOT INCREASE THEIR INCOME TAX. Considering the state of the market and the time it is taking for some lenders to foreclose, even homeowners that have already missed payments may find that the lender’s delay in foreclosing results in the debt being forgiven in 2013 after the Act expires. Closing a short sale prior to the end of this calendar year results in the debt being canceled in time for the homeowner to take advantage of the Mortgage Forgiveness Debt Relief Act (as long as the canceled mortgage debt was used to purchase or improve the borrower’s primary residence). Waiting could result in the homeowner incurring income tax on the amount of the deficiency, and many markets are seeing deficiencies over $100,000. Coupled with the difficulty in discharging tax debt through bankruptcy and the collection tools at the IRS’s disposal, waiting to “see what happens with my foreclosure” could result in a nightmare for the homeowner.

I have attached some information from the IRS website (www.irs.gov) on the tax ramifications of cancelled debt and the Mortgage Forgiveness Debt Relief Act of 2007.

Existing Home Inventory declines 17% year-over-year in January – Or Why You Can’t Find A House To Buy

Check out this great article from the folks over at Calculated Risk Blog. It helps explain why housing inventory for sale is so incredibly low. Don’t worry housing inventory for is going to increase.

Another update: I’ve been using inventory numbers from HousingTracker / DeptofNumbers to track changes in inventory. Tom Lawler mentioned this last year.

According to the deptofnumbers.com for monthly inventory (54 metro areas), listed inventory is probably back to early 2005 levels. Unfortunately the deptofnumbers only started tracking inventory in April 2006.

This graph shows the NAR estimate of existing home inventory through December (left axis) and the HousingTracker data for the 54 metro areas through January.

Since the NAR released their revisions for sales and inventory, the NAR and HousingTracker inventory numbers are tracking pretty well.

Seasonally, housing inventory usually bottoms in December and January and then starts to increase again in February. So inventory should increase over the next 6+ months.

The second graph shows the year-over-year change in inventory for both the NAR and HousingTracker.

HousingTracker reported that the January listings – for the 54 metro areas – declined 17% from the same month last year. The year-over-year decline will probably start to slow since listed inventory is getting close to normal levels. Also if there is an increase in foreclosures (as expected), this will give some boost to listed inventory.

This is just inventory listed for sale, sometimes referred to as “visible inventory”. There is also a large “shadow inventory” that is currently not on the market, but is expected to be listed in the next few years. Shadow inventory could include bank owned properties (REO: Real EstateOwned), properties in the foreclosure process, other properties with delinquent mortgages (both serious delinquencies of over 90+ days, and less serious), condos that were converted to apartments (and will be converted back), investor owned rental properties, and homeowners “waiting for a better market”, and a few other categories – as long as the properties are not currently listed for sale. Some of this “shadow inventory” will be forced on the market, such as completed foreclosures, but most of these sellers will probably wait for a “better market”.

However listed inventory has clearly declined in many areas. And it is the listed months-of-supply (currently 6.2 months) combined with the number of distressed sales that mostly impacts prices.

Getting Married – What to Do When You Have Negative Equity In Your Real Estate

Getting married? Congratulations!

Own a home that is underwater? That could be a problem. But not an insurmountable one.

If you have been reading the wedding blogs you know that most couples do not discuss their finances, credit scores, assets and liabilities, and future financial goals and the plans to reach them. That is really too bad because marriage is a partnership and that partnership includes your financial business.

Most couples I talk to are already married before they realize that they need to do something about their underwater real estate. The situation typically involves one of two scenarios. In the first scenario both partners own their own property. Typically the couple will move into one partners property and are trying to figure out what to do with the other home. The second scenario usually happens a few years down the road when their current home no longer meets their needs and they need more space, better schools, a yard, etc.

Before we discuss any options, let’s be clear on one thing, the market is NOT “coming back”. Expecting the market to “recover” to peak levels is a fallacy that many upside down homeowners lovingly cling to. It is time to get real, the market was a bubble. The bubble burst. Prices are not going to recover to peak levels for decades. Get over it already and plan accordingly.

In either of these scenarios the options are as follows:

Rent the property and hold it as an investment property. For high earning couples this can be a great option as it gives them a tax deduction. Of course, all of the headaches, repairs and maintenance associated with the property will be all theirs as well. Renting will also allow the couple to pay off the property or pay it down over time until they reach a point where they are able to sell the property. Of course by then, the property may require extensive updates as home fashions change.
Short sale the property. This option allows the couple to sell the property and settle the debt.
Let the property go to foreclosure. This option takes about a year (or longer) in Minnesota. Most lenders will foreclose via advertisement on a residential property in MN. Generally a lender waives their right to pursue the the borrower for any deficiency should the sale of the property not repay the mortgage debt in full. This applies only to the mortgage that foreclosed (typically a first mortgage). If there is a second mortgage or any other junior liens, they may continue to pursue you for the debt post foreclosure. The advice of a good attorney is important if you go this route. I recommend Jerry Probst at J Probst Law . While the property is going through the foreclosure process, you are the legal owner and are responsible for the property. This includes paying home owners insurance, association dues, utility bills, maintenance, repairs, etc.

Mortgage Rates Set New Record Lows

With property values across the country at depressed levels and interest rates dancing around historical lows for months now, housing affordability has hit an all-time high. That affordability inched even higher this week, as mortgage interest rates broke through their previous record lows to fall further still.

Freddie Mac says all loan products covered in its regular weekly market survey eased to set new all-time lows for the week ending January 12, 2011.

The average rate for the 30-year fixed mortgage has been below 4.00 percent for six consecutive weeks now. This week, it dropped to 3.89 percent (0.7 point), down from 3.91 percent last week. Last year at this time, the 30-year rate averaged 4.71 percent.

The 15-year fixed-rate mortgage this week averaged 3.16 percent (0.8 point), falling from 3.23 percent last week. A year ago at this time, the 15-year fixed mortgage averaged 4.08 percent.

Adjustable-rate mortgages (ARMs) also declined to hit new record lows. The 5-year ARM is now averaging 2.82 percent (0.7 point), down from last week’s average of 2.86 percent. This time last year, the 5-year ARM was 3.72 percent.

The 1-year ARM averaged 2.76 percent (0.6 point) this week, compared to 2.80 percent last week. Dial back 12 months, and the 1-year ARM came in at 3.23 percent.

Freddie Mac’s chief economist Frank Nothaft notes that declines appeared across all loan products even with news of mixed indicators in the labor market.

“Although the economy added 1.6 million jobs in 2011, which was the most since 2006, the unemployment rate remained historically elevated. The 2009 to 2011 period had the highest three-year average unemployment rate since 1939 to 1941,” according to Nothaft.

He adds that “the Federal Reserve indicated in its January 11th regional economic review that most industries saw limited permanent hiring at the end of last year.”

Freddie Mac’s weekly mortgage rate survey is based on data gathered from 125 lenders – including thrifts, credit unions, commercial banks, and mortgage companies – from across the country.
